The Mental Health Court
commenced as a 3 year pilot 
project to develop a model which
could be used by the Provincial
Court to deal with those persons
with a mental illness or intellectual
disability who are in conflict with 
the law.  It is now a permanent 
program of the Provincial Court.

 There are two main phases in the 

 Mental Health Court process. 

 1.The Admission phase consists of 

 four components: Presentation,

 Eligibility, Compliance and 

 Acceptance

 2. The Program phase during  

 which an accused participates in a

 judicially monitored program. 

 This phase continues until the

 accused graduates, voluntarily 

 withdraws or is removed from the

 program.

 

 Mental Health Court is the name

 used to identify an innovative process

 of the Provincial Court of New

 Brunswick
